General Contest Rules for 94.5 WLWK
The following rules apply in contests or promotions associated with WLWK-FM, which is owned and operated by the Journal Broadcast Group, Inc. By participating in any such contests or promotions, participants agree to be bound by these rules. In addition, particular contests and promotions may have rules that are specific to those contests or promotions. If the particular rules for a specific contest or promotion conflict with the following general rules, the particular rules will control.
1. No purchase necessary to win. Limit one winner per household per contest on WLWK-FM.
2. Employees, former employees, their immediate families, and/or those living in the same household of WLWK-FM or any affiliate of Journal Broadcast Group, Inc., or other radio stations and media outlets are not eligible to win 94.5 WLWK contests.
3. Prize winners must be at least 18 years old, unless otherwise specified.
4. WLWK awards all prizes locally, so winners must live in one of the following counties: Washington, Waukesha, Ozaukee, Racine, Milwaukee, Kenosha, Jefferson, Sheboygan, Dodge, Fond du lac, Manitowoc, or Walworth County in Southeastern Wisconsin.
5. Due to the nature of our programs that are heard online over the Internet, contests heard on the radio station’s Internet audio stream are slightly delayed from the time the contest is heard on the broadcast station, and will be running behind the broadcast signal. Thus, all contests heard are delayed. This delay can last for 30 seconds up to several minutes. This means that when 94.5 WLWK announces it’s time to call to play the contest, listeners to the online audio stream may be at a disadvantage in participating over those listeners who hear the contests on a conventional FM radio.
6. WLWK-FM reserves the right to substitute prizes of equal or greater value; winners do not have any right to substitution of prizes.
7. Prizes are non-transferable and may not be redeemed for cash or any other prize/merchandise.
8. Where a prize consists of tickets for a sporting event, concert, movie, play or similar event, WLWK-FM will not be responsible for cancellation. In that event, the winner must deal exclusively with the promoter of the event.
9. By participating, entrants agree to release, discharge and hold harmless 94.5 WLWK and Journal Broadcast Group, Inc., their subsidiaries and affiliates and their respective directors and employees from any liability, claims, losses, damages and injuries arising directly or indirectly, in whole or in part, from their participation in the contest and the acceptance and use of a prize. WLWK makes no warranties regarding the safety, condition, or fitness of any prize awarded, and will not be responsible for any loss, damage or injury suffered by a winner and any parties thereof, through the use of any awarded prize.
10. Winners are solely responsible for all taxes, duties, or other costs that may be associated with the winning of a prize.
11. To receive a prize, winners are required to complete and sign an affidavit of eligibility/prize acceptance form and present a government issued legal picture I.D. (such as a driver’s license) to WLWK-FM within 14 days of winning at the WLWK offices located at 720 East Capitol Drive, Milwaukee, WI 53212 during regular business hours Monday through Friday, 8 a.m. – 5 p.m. (except holidays when the office is closed). If the I.D. does not contain their current address, the winner must also present a piece of mail addressed to the winner at his/her current address with an official USPS postmark stamped within 30 days of winning the contest.
12. Any contest winner who cannot claim their prize during regular business hours may, upon informing WLWK, request the following: To have a third party claim their prize during regular business hours provided that the contest winner sends a letter stating the reason(s) for which the contest winner cannot claim their prize in person and permission with the full name of the third party who will claim their prize. A photocopied form of photo identification of the contest winner (for example, a driver’s license or passport) and the winner's social security number must also accompany the letter. The third party, upon claiming the prize for the contest winner, must also provide a form of photo identification that will be photocopied for WLWK contest files. The contest winner agrees that WLWK will not be liable for lost, stolen or damaged prize certificates or merchandise as a result of negligence by the third party. No exceptions to any part of this rule will be made.
13. Any prize not claimed within 14 days of winning will be forfeited by the winner and will remain the sole property of WLWK.
14. In the event that a prize or prize certificate is mailed to the winner, the winner assumes the risk of its arrival. WLWK-FM is not responsible for safe arrival of a prize or prize certificate. WLWK-FM will not be responsible for mail that has been lost, damaged or delayed.
15. Anytime you call the WLWK-FM studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record it for later broadcast on 94.5 WLWK-FM and on the station’s internet stream at www.945lakefm.com.
16. Participating in a WLWK-FM contest and/or accepting a prize constitutes permission to the sponsor, radio station, and its agencies to use the participants and winners name and/or likeness for promotional, broadcast, internet, advertising or trade purposes without further compensation.
17. As winner of a 94.5 WLWK contest, entrant agrees not to appear on, or on behalf of, any other radio or television station for a period of six (6) months upon acceptance of prize.
18. Odds of winning a contest are dependent upon the number of eligible entries received. 94.5 WLWK and Journal Broadcast Group, Inc., their subsidiaries and affiliates and their respective directors and employees are not responsible for any error, omission, interruption, deletion, malfunction, defect or delay of any kind in telephone calls, radio transmissions, or on-line or internet submissions or for the failure of 94.5 WLWK to receive telephone calls for any reason or for any computer or software malfunction of any kind affecting the proper execution of any contest.
19. WLWK reserves the right to disqualify any winner if any contest rules are violated in any way.
20. As a licensee of the FCC and trustee of the public airwaves, 94.5 WLWK reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of 94.5 WLWK management if world events, the national mood, or public safety so warrant.
21. By participating in this contest, entrants agree to be bound by the Official Rules and the decisions of the judges.
22. 94.5 WLWK reserves the right to amend the rules to any contest at any time.
23. The decision of 94.5 WLWK management is final.
